General Terms and Conditions of caligri GmbH
These General Terms and Conditions govern the relationship between caligri GmbH (Ettighofferstr. 70, 53123 Bonn, Germany; info@caligri.com; +49 221 98652725) and customers for products ordered or leased via caligri.com and email.
Customers may review, print, and archive these GTC. Customer terms conflicting with these GTC require express written consent. German or English are contract languages, with German prevailing in disputes. Consumers are natural persons whose transactions aren't primarily commercial; entrepreneurs are entities acting in commercial capacity.
Customers must be at least 18 years old; minors need legal guardian consent. Product depictions on the website constitute non-binding proposals. Customers request offers via email (info@caligri.com) and receive binding offers in PDF format containing contract data and GTC. Upon acceptance, caligri sends order confirmation.
Caligri reserves the right to change prices proportionately if material prices, manufacturing costs and/or personnel costs as well as exchange rates for imported goods change after conclusion of the contract.
If a customer cancels requiring caligri's consent, actual expenses or 25% of net order value applies—whichever is greater.
Caligri archives contract copies; customers lack online access. Customers may print order data before completion and receive email confirmation with all relevant data.
Uses exceeding granted rights or product misuse are prohibited. The Customer shall undertake to indemnify caligri and its fulfilment agents against any and all reimbursement entitlements of third parties as well as all expenses that result from an illegal use of the products procured.
No minimum order value exists. All prices are quoted in Euro and already include applicable value added tax. Shipping costs aren't included. Customers contact info@caligri.com for shipping information. Customers bear customs clearance and import duty costs.
Invoices are sent exclusively via email. Payment options include cash advance, debit note, PayPal, or credit card without additional charges.
If the Customer should be in default of payment or if a charge to a credit card should not be possible for reasons the Customer is responsible for, caligri shall have the right to charge the related incurred costs to the customer.
Customers must promptly notify caligri of banking information changes. Caligri doesn't reserve ordered goods; if items are sold out upon payment receipt, caligri notifies the customer promptly.
Delivery times apply within Germany and begin upon payment receipt. If the last delivery day coincides with Sunday or government holiday, the following business day becomes the due date. For non-compliance, customers may set a reasonable remedial period (minimum two weeks).
Caligri shall organize transports exclusively via professional shipping companies or parcel delivery services.
Partial deliveries at caligri's expense are permitted if reasonable for customers. If caligri suppliers fail contractual obligations and caligri made congruent coverage transactions, caligri may rescind. Customers are promptly notified, and payments are refunded.
If the fulfilment of the delivery obligations should not be possible due to force majeure the delivery time shall be reasonably extended.
Customers assure correct delivery addresses; erroneous addresses resulting in repeated delivery costs are customer's responsibility.
In the event of the unwinding of a purchase agreement, the amounts already paid to caligri by the Customer shall be refunded at the latest within 14 days, provided caligri has already received the returned goods or the Customer documents that Customer has shipped the goods.
Consumers as defined in law are entitled to revocation rights for remote sales or off-premises contracts. The Revocation Information, along with information on the consequences of revocation as well as a sample revocation form shall be provided to the Customer for contracts made for remote sales under the link Revocation Information on www.caligri.com.
Unless otherwise agreed upon, the direct costs for the return shipment shall be for Customer's account. This information appears under Revocation Information.
Purchased goods remain caligri's property until full payment. For entrepreneur customers, title retention applies until all accounts payable are settled.
Prior to title transfer, attachment, collateral conveyance, processing, or conversion without caligri consent are prohibited. The Customer shall notify caligri of any third party access, in particular court enforced collection measures as well as other impairments of the property promptly and in writing.
Customers reimburse caligri for damages and costs from breaching this obligation. Entrepreneur customers may resell goods in regular business transactions and assign resulting accounts receivable to caligri in invoice amounts. If collateral exceeds secured receivables by over 10%, caligri releases collateral at its discretion upon demand.
Lease term duration appears in product descriptions on www.caligri.com, measured from pickup to return. The leasing cost, unless otherwise agreed upon, shall be due for payment in one single amount for the entire leasing period within 14 days after the invoice date.
Customers outside Germany must transfer full amounts before accepting leased objects. Customers cover all operation and possession costs including taxes, insurance, maintenance, and repairs. The Customer shall be in position to exercise a right to retain only if Customer's counter demand is based on the same contractual relationship.
Caligri may require security deposits or collateral before handover, defined by leased item value and lease term. Security deposits must be paid before lease commencement. If deposits aren't received timely, caligri may rescind the contract. The Customer shall not be permitted to set off the security deposit against other accounts payable, in particular leasing fees and/or claims for damage compensation.
Deposits are refunded after return if no further claims exist. Customers must accept leased objects immediately upon availability notice at agreed venues unless otherwise arranged. Rental objects shall be packaged, delivery and (transportation) insured exclusively on the basis of the Customer's instructions and for Customer's account.
Customers must examine leased objects immediately upon delivery for obvious deficiencies at their expense, documenting objections in handover logs. Non-obvious deficiencies are reported immediately upon detection in text format. Objects remain available for caligri or third-party inspection and proper storage.
The Customer assures caligri that all individuals who operate leased objects are qualified to operate them and, if required (by law) are in possession of mandates qualification certificates, driver's licenses, certificates and the like.
Customers must handle and operate leased objects properly, transport them safely, and comply with government safety requirements. The Customer shall ensure that the leased devices are handled in compliance with the provisions of the manufacturer / the operating manual and that any due maintenance work by the Customer is performed in a timely manner by an accredited professional service provider.
Improper use includes untrained personnel operation, non-intended uses, excessive/overloaded handling, inadequate consumption material filling (lubricants, oils, frost protectants), unauthorized repairs, and safety installation bypasses.
Upon damage, customers promptly notify caligri and await instructions. The Customer shall perform any support work to minimize the damages incurred or at the very least to prevent its escalation and shall comply with all of caligri's instructions.
If customers apply for insolvency proceedings, caligri may rescind and demand immediate device return. At lease end, objects are promptly returned with accessories, manuals, and service documentation.
Upon their return, the leased devices shall be in a condition on par with their age and in compliance with the contractual use, free of any damages, cleaned, usage safe and operationally ready.
Parties compile and sign return logs documenting return condition; both must sign. Caligri shall have the right to charge the Customer for any additional work necessary due to deficient cleaning and/or inadequate sorting of the device or its accessories.
Either party may terminate for important grounds before expiration. Caligri may terminate immediately if customers default on two instalments, suspend payments, offer out-of-court settlements, or apply for insolvency.
Claims of consumers based on deficiencies of used objects shall be subject to a statute of limitations of one year as of the date of handover of the sold item. Statutory provisions otherwise apply.
Warranty claims are subject to one-year statute of limitations from risk transfer, excluding intentional/malicious acts or assumed condition warranties. Entrepreneurs must inspect goods upon receipt with reasonable due diligence and report obvious damages without culpable delays in writing. Non-obvious deficiencies are claimed upon discovery without culpable delays; timely sending constitutes compliance.
Upon material deficiency materialization, caligri chooses—at reasonable discretion—repair or replacement. Replaced parts shall be the property of caligri. For entire object replacement, caligri receives usage compensation. Statutory provisions otherwise apply.
Damage compensation and cost reimbursement entitlements follow § 14 provisions regardless of customer status.
Unless written agreement states otherwise, calculations use these rates:
One unit corresponds to 30 minutes each. Customers contact info@caligri.com for additional service information.
Caligri shall charge 0.40 EUR per kilometer for travel by car to and from the place of deployment. Flights and train journeys charge actual expenditure plus 50% of the stated rate. Expenses like overnight stays, board, journeys from and to the hotel go in principle to the debit of the customer and are calculated according to the actual expenditure.
Regular working hours for services in § 11 1a and b are 9:00 a.m. to 4:00 p.m. on working days. Services exceeding standard hours are charged per customer agreement.
The working time for service according to §11 1c.–f. will be charged with at least 10 working hours. The maximum working time is 10 hours including paid lunch break.

Deviating billing requires written agreement before order commencement.
The protection of personal data of the customer when collecting, processing and using the former in conjunction with a visit to the caligri website, is an important issue in caligri's eyes.
Caligri complies with EU General Data Protection Regulation, German Federal Data Protection Act, German Telemedia Act, Telecommunications-Telemedia Data Privacy Act, and applicable data protection provisions. Data Privacy Policy details are accessible via Privacy Policy on www.caligri.com.
Caligri consistently strives to make available its website www.caligri.com without any interruptions and to ensure the error free transfer of all data exchange via the site. However, due to the nature of the Internet this can not be guaranteed.
Unforeseeable system failures, necessary maintenance, repairs, and new service introductions may occur. If data losses should occur, caligri shall not assume any liability, unless these situations are caused by grossly negligent or intentional acts of caligri.
§ 14 (Liability) provisions apply notwithstanding above.
For damages from minor negligence, caligri assumes liability only if claims involve cardinal contractual obligations, loss of life, physical injury, health damages, product liability claims, or assumed quality guarantees. Cardinal obligations are such duties the fulfilment of which is necessary to make the proper performance of the contract possible and in the compliance with which the contracting Partner could trust.
Minor negligence liability for default damages is limited to typically foreseeable damages.
Provisions limiting liability apply equally to cost reimbursement limitations (§ 284 BGB). The above limitations of liability shall also apply for the benefit of the fulfilment agents and statutory representatives of caligri.
Article images' copyrights are held by caligri. Any use of the images in the absence of caligri's express consent shall be prohibited.
The images used to describe the goods are sample photographs. They do not represent the actual item in every case, but are used for visualization purposes. Screen display may alter colors and sizes; item descriptions are determinative.
Product promotional use and sweepstakes participation require prior caligri consent.
The content and works used by caligri on its websites, in particular under www.caligri.com, are governed by German copyright legislations. Reproduction, editing, distribution, and uses outside copyright limitations require written consent from authors/originators. Third-party content is identified as such.
If you should come across a copyright infringement despite these precautions, we ask you to notify us accordingly. In the event that we should become aware of legal violations, we shall promptly remove such content.

Caligri is neither under any legal mandate nor willing to voluntarily participate in an out-of-court settlement of online disputes by a Consumer Mediation Agency.
The contractual relationship shall be governed by German law subject to the exclusion of the UN Convention on the International Sale of Goods, unless mandatory statutory provisions require otherwise.
Exclusive jurisdiction for entrepreneur, legal entity, and public law contracts is caligri's business domicile. In the event that any specific provisions of these GTC should be ineffective or unenforceable or become so after the execution of the contract, this shall not affect the effectiveness of the remaining contract.
Statutory provisions apply in lieu of ineffective provisions or contract omissions.
